JobsOhio Lawsuit Plaintiffs File for a Restraining Order Against the State

(WYSO) - The groups that filed a lawsuit against the state over the JobsOhio program have filed a new motion - asking the state's highest court to stop the state from moving forward with plans for that program. In an interview with Ohio Public Radio's Jo Ingles, Brian Rothenberg of ProgressOhio explains his group wants the Ohio Supreme Court to grant an immediate restraining order against the state.

"The only reason we're in the Supreme Court," says Rothenburg, "is because when they originally wrote the legislation, they forced us to file a lawsuit in the Supreme Court within a certain period of days. And if we hadn't done it, you were actually put in a position of not being able to sue at all, ever, about JobsOhio. So on it's face, it's unusual to be in the Supreme Court at this level and it's unusual to have to file a cease-and-desist temporary restraining order request in the Ohio Supreme Court."

Rothenberg added his group has serious questions about the constitutionality of JobsOhio for several reasons. Governor Kasich says JobsOhio, the new non profit private board that will oversee job creation in Ohio, will be able to compete better with businesses because it won't be bogged down by unnecessary rules and regulations.
