NYS Attorney General Says Court Ruling Does Not Endanger Same Sex Marriage Law

(WXXI) - State Attorney General Eric Schneiderman, who is defending a lawsuit against the state's same sex marriage law, says he believes there's no danger that the law will be overturned.

AG Schneiderman's office will likely be defending the state's same sex marriage law in Court, now that a Supreme Court judge in Western New York has sided with evangelical Christian groups, and ruled that a portion of their lawsuit can continue. The case won't be about the substance of the law, but rather the procedural vote in the State Senate. The groups accused the Cuomo Administration of heavy handed tactics which quelled debate by Senators. The judge ruled that there was evidence of "arm twisting", and that a private meeting between Cuomo and some Senators might have violated the state's open meetings law.

Schneiderman says he disagrees with the ruling, and the judge's interpretation of the open meetings law, but says the court order does not affect the new law's status.

"Same sex marriages can legally take place in New York," said Schneiderman." This has not in any way, shape or form changed the law."

The AG predicts the case could ultimately be decided by an appeals court.
