Ala. Supreme Court Issues Stay In Veto Suit

(APR - Alabama Public Radio ) - The Alabama Supreme Court has blocked a circuit court hearing Wednesday in Montgomery on a lawsuit that four legislators filed against the governor.

The state's highest court issued a stay late Tuesday afternoon at the governor's request.

Montgomery County Circuit Judge Truman Hobbs had scheduled a hearing on the lawsuit at 10 a.m. Wednesday, but the circuit court proceedings are on hold for now.

Riley has asked the Supreme Court to step in and rule that the legislators can't challenge his use of a line-item veto on the state General Fund budget. The Supreme Court will take briefs on that issue and then decide.

Members of the Legislature's Joint Fiscal Committee filed the lawsuit after Riley struck language from the budget that described which agencies would lose funds if tax collections fall below expectations.
