Judge Dismisses Suit Against Housing Commission
(APR - Alabama Public Radio ) - A federal judge dismissed a lawsuit filed by a trucking company challenging the Alabama Manufactured Housing Commission's right to regulate transportation of manufactured housing in the state.

Lyman Agency, Incorporated and a corporate officer, Van Taylor, had sued arguing that its license as a federal motor carrier for hire pre-empted state regulation. The Attorney General's office said in a statement that U-S District Judge Karen Bowdre dismissed the suit Wednesday.

The A-G's office said in a statement that Federal law allows some state regulation of federal motor carriers for hire, especially regarding safety issues.

Prosecutors had argued that damage potentially resulting from improper transportation of manufactured housing could endanger the safety of the home's future occupants.

Bowdre ruled that the Alabama regulations are permissible because they are made to address safety concerns arising from transportation.
