Wrongful Imprisonment Settlement
(2008-07-29)
(WOUB) - A judge has approved a $600,000 state
settlement to a southern Ohio man who pleaded guilty to murder, served nine years and then had his conviction overturned.

The wrongful imprisonment settlement signed Tuesday by Ohio
Court of Claims Judge Joseph Clark includes damages plus compensation for wages lost by Kenneth Moore during his
incarceration.

The Chillicothe man's plea and conviction in the 1995 shooting death of Darrel Benner were erased on appeal,
with a court finding that Moore's attorneys did not inform him of
evidence helpful to his case.

A second trial found Moore not
guilty.

When the settlement was proposed earlier this year, it drew complaints from Benner's family and the prosecutor in Pike County, where the killing occurred.
