Scioto County judge recuses himself in murder case
(WOUB) - A Scioto County judge is recusing himself from a murder case involving a farmer accused of shooting a teenager who allegedly tried to take a bale of hay from his property.

Thirty-five year old Eric Whisman of Blue Creek has pleaded not guilty to two counts of murder stemming from an October incident in which 17-year-old Nathaniel Kennedy of Chillicothe was shot and killed.

Investigators say Whisman shot at two boys taking a bale of hay from his home.

Kennedy was killed while the other boy was not injured.

Scioto County Common Pleas Court Judge William Marshall says he has a conflict of interest in the case.

Marshall says his 8-year-old daughter is friends with Whisman's daughter.

He's asking that the Ohio Supreme Court appoint a new judge to preside over the case.

In addition to murder charges, Whisman is also facing two counts of felonious assault and one count of discharging a firearm.
