AG says no DNA evidence in Spirko murder case
(2008-01-03)
(WOUB) - Attorney General Marc Dann has concluded that no DNA evidence links condemned inmate John Spirko with the killing for which he was sentenced to die.

Dann's office is making the determination after finishing years of testing on samples of DNA collected from the 1982 killing of northwest Ohio postmistress Betty Jane Mottinger.

Dann spokesman Leo Jennings says the conclusion does not mean Spirko is innocent and also does not mean he is guilty.

Jennings says the findings just confirm what has long been believed about the lack of a DNA match.

Spirko was convicted based on witness statements and his own
comments to investigators.

He previously received seven reprieves while the testing was done, a record under the state's new death penalty law.
