Ohio Supreme Court asked to review disclosure rules
(2007-12-16)
(WOUB) - The Ohio Supreme Court is being asked to take a new look at court rules on how much information prosecutors are required to turn over to defense attorneys.

On one side is a defense team which argues they need police reports so the defendant can get a fair trial.

But prosecutors complain that disclosing some information can put innocent lives in danger.

That's certainly the case with witness statements, according to Athens County Prosecuting Attorney David Warren.

Warren points out prosecutors are already required to turn over favorable evidence to the defense.

He says if the Supreme Court does change the rules, the entire judicial system could suffer.

The case in question is from Cleveland but the decision could set a statewide precedent.
