Strouds Run panic charges dismissed
(WOUB) - A Millfield man is no longer charged with being the person responsible for the closing of Strouds Run State Park beach one day last summer.

Littering and inducing panic charges against John Fisher were dismissed Tuesday.

Athens City Prosecutor Mike Miller says he had subpoenaed two witnesses to appear, but they did not, and he was not confident they would come for Fisher's trial on Thursday.

Miller says without their testimony, he would not be able to prove all the elements of the offense, including the identity of the responsible person.

Fisher was accused of placing tennis balls into the lake, causing concern that the water was being tainted with a hazardous substance.

Miller says he can refile the charges "if the witnesses come forward."
