Supreme Court turns down appeal from man set for execution

(WOUB) - The US Supreme Court has rejected an appeal from an Ohio man scheduled to be executed today for gunning down his wife.

James Filiaggi was to be put to death at 10 am, but officials waited to hear from the nation's highest court.

State prisons spokeswoman Andrea Dean says Filiaggi has no further appeals, so the execution is now moving forward.

Defense attorneys had sought a delay so the man from Lorain could join a lawsuit arguing that lethal injection is unconstitutional.

Yesterday, three lower courts refused to hold up the execution. Governor Strickland also wouldn't delay it.

Filiaggi was convicted in the fatal shooting of his former wife Lisa Huff Filiaggi 13 years ago.
