Case against former Police Officer is now closed

(WOUB) - The Bureau of Criminal Investigation's case against a former Athens Police Officer is now officially closed but new allegations against him are coming to the surface.

Brian Lushbaugh pleaded guilty to two counts of dereliction of duty last week after admitting to having sex with two women he supervised in the police department's Explorer ride along program between 1998 and 2001.

However, in the case file detailing the investigation there are accusations that Lushbaugh recruited male explorer members to have group sex with him and his wife and allegations that the sex with the two female members was not consenual.

An anonymous letter from a former female explorer started the investigation.

The writer of that letter claimed Lushbaugh raped her while on duty.

A second former female Explorer interviewed during the investigation also said the sexual contact she had with Lushbaugh was against her will.

BCI Special Agent Larry Willis says even though the allegations are very serious the misdemeanor charges that were filed against Lushbaugh are what was best for the victims.

Lushbaugh claims sex with the women was consensual and both were at least 18 years old at the time.

He was sentenced to one year probation, a $1,500 fine and forfeiture of his badge.
