Davis Removed from Council Committees
"I think it's pretty clear in reading those cases of what Mr. Davis pled guilty of, as he soon he pled guilty, the seat was vacant," said Council President David Franczyk, who wasn't sure if Davis was even "present in the building."
WNED News' attempt to reach Davis by phone was unsuccessful.
The city's top lawyer, acting Corporation Counsel David Rodriguez, was asked for a ruling.
"I want to make sure that we do things right and proper and legally," said Franczyk.
The lawyers are looking at the earlier case of former Erie County Legislature Chairman George "Butch" Holt who was forced out of office after pleading guilty to two counts of filing fraudulent tax returns, a removal upheld by a state appeals court.
Davis pleaded guilty to using campaign contributions for personal use and lying to the Board of Elections about the spending.
