Nine districts in Michigan, Texas and Vermont argued they shouldn't have to comply with certain requirements of the education law if the federal government doesn't pay for them.
Lawyer Dennis Pollard says Friday's 8-8 vote by the 6th U.S. Circuit Court of Appeals means a lower court's decision stands.
In 2005, a federal judge in Detroit ruled in favor of the U.S. Education Department and dismissed the lawsuit. Pollard, who represent the Pontiac, Mich., School District, says the case is over unless someone wants to petition the U.S. Supreme Court.
