(wgvu) - The Michigan Court of Appeals has ruled
that county clerks cannot mail unsolicited applications for
absentee ballots to the elderly.
Four plaintiffs recruited by the Michigan Republican Party sued
Macomb County Clerk Carmella Sabaugh, a Democrat, after her office
mailed absentee ballot applications to residents 60 and older in
2006.
A circuit judge ruled in the clerk's favor.
But the appeals court released an opinion Friday ruling
Sabaugh's actions unconstitutional. The court says she lacked
authority to mail unsolicited applications and violated the
"purity of elections" clause in the Michigan Constitution.
Sabaugh says the ruling will reduce voter turnout in November.
