Hyundai Wins on Appeal
$8.1 million judgment against Hyundai over the backward collapse of
a front seat.
A split three-judge panel in Washington state says a trial judge
erred in reinstating a jury award after finding the South Korean
automaker withheld key documents in a lawsuit by a 49-year-old
crash victim.
The suit alleged that the force of an air bag in a rented 1996
Hyundai Accent broke a seat reclining mechanism and threw him out
the car's hatchback. The victim has been left paralyzed. A
passenger in the back seat suffered a broken leg.
A jury had found the seat design faulty in 2002 and awarded $8.1
million to the paralyzed man. That verdict was overturned two years
later, but a judge reinstated the award in 2006.
