Snellville seeks new trial on Sunday liquor sales ATLANTA (WABE) - Snellville city leaders say an ordinance passed in December authorizing beer and wine sales on Sunday is indeed valid. The city is now asking for a re-trial to present new information.

A Gwinnett judge ruled in January that Snellville's city council broke the law by passing the ordinance allowing alcohol sales without a referendum. Since the ruling, the seven licenses the city issued for Sunday sales have been void.

Mayor Jerry Oberholtzer now says the city has proof that it never had to hold a referendum. He says the author of the law has filed an affidavit saying city councils do in fact have the right to permit alcohol sales on their own.

"I think it shows a different light on the case," said Oberholtzer. "The judge had repeatedly asked, What was the intent of the law?' I think now we've shown to him we have an affidavit from the author of what the intent was and it bolsters our argument of what we're doing is correct."
