Davis Lawyers File Petition with Supreme Court

(WABE) - Tonight, supporters of death-row inmate Troy Davis will rally at the State Capitol. Also today, Davis's lawyers filed a petition with the U.S. Supreme Court, asking that a district court hear new evidence that they say shows his innocence.

WABE's Odette Yousef reports.

Davis was convicted in 1991 of killing Savannah Police Officer Mark Allen MacPhail. Seven of the nine state witnesses who implicated him have since recanted.

Jason Ewing, one of Davis's lawyers, knows that the high court rarely grants writs of habeus corpus:

EWING: We hope in this case that we have shown that it's exceptional, and that it deserves some kind of exceptional jurisdiction by the court.

Davis's options to avoid the death penalty are nearly exhausted. His last stay of execution expired on Saturday.

As the high court considers the latest filing, Ewing hopes Chatham County's District Attorney will hold off on applying for a death warrant. Last September, a trial judge went ahead and signed a death warrant for Davis, even though an appeal was pending before the U.S. Supreme Court. Tthe high court issued a last-minute stay.
