Waffle House Worker Sues Gwinnett Police Over Taser "Prank"

(WABE) - The Gwinnett County Police Department says two other officers were also present when Corporal Gary Miles allegedly used the Taser. Both have since resigned.

The victim, a 22-year old Waffle House employee, claims the February attack was unprovoked, and that the accused officer considered it a prank.

Department spokeswoman Corp. Ilana Spellman couldn't comment on the lawsuit, but says the apparent Taser use does not fit within county guidelines.

"That is not reflective of the training and standards that our officers are held to. We have a lot of officers that carry Tasers. This is the first incident of its kind, and we hope it's an isolated incident."

Spellman says Taser use is only permitted when someone an officer is trying to arrest does not comply with verbal commands.

The Waffle House employee was working at the time, and not under arrest.
