State flag-desecration statute to see challenge
(NET Radio) - Shirely Phelps-Roper was arrested earlier this month for allowing her 8-year-old son to stomp on an American flag at the funeral of a U-S soldier in Bellevue, just south of Omaha. Phelps-Roper is a member of a Topeka, Kansas, church that stages anti-gay protests at funerals of soldiers across the country. She was charged with disturbing the peace, contributing to the delinquency of a minor, and - under a 1977 state law that's rarely enforced - flag mutilation. Her attorney, Bassel El-Kasaby, says he will challenge the constitutionality of the Nebraska flag-mutilation statute. © Copyright 2017, NET Radio
