Bill Guarantees Workers' Comp for Undocumented

(Michigan Radio) - Legislation set for introduction in the state House would allow illegal immigrants to receive worker's compensation if they're injured on the job.

State Representative Steve Tobocman is the bill's sponsor. He says Michigan is one of a handful of states that denies wage-loss benefits to undocumented workers.

"As a result, there's a perverse incentive in Michigan for businesses to hire undocumented labor," says Tobocman. "They don't have to pay lost wages and hours. They're able to tax these folks on their wages, but if they get hurt on the job, they don't have to pay their wages and hours."

In 2003, the Michigan Court of Appeals said using fake documents to get a job is a crime. It said Michigan's workers' compensation law calls for the suspension of benefits if an employee cannot work because he's committed a crime.
