Oakland University Student Can Live On Campus

(Michigan Radio) - Micah Fialka-Feldman has been taking classes at Oakland University since 2003, but when he applied to live on campus he was rejected. Fialka-Feldman is in an options program designed for students with intellectual disabilities who won't complete a degree.

He's been attending classes full-time and felt living on campus was part of the college experience.

"I wanted to go to college and I think I should have the full college time and stuff," Fialka-Feldman said.

Chris Davis was Fialka-Feldman's attorney on the case. He argued that the University's refusal to waive its policy on housing was a violation of the Rehabilitation Act.

"Some of the justifications that they used were that he might not be able to care for himself and things of that nature - but they were groundless," Davis said.

Fialka-Feldman will be on campus by January. The ruling came just in time for his last semester.
