Locals struggle with marijuana law
(2010-08-16)

(Michigan Radio) - Michigan's medical marijuana law is creating headaches for many communities.

Some local governments have enacted moratoriums while they study the law. Some have sought to limit dispensaries through zoning. And some have adopted ordinances that ban medical marijuana within their borders.

Legal analyst Charlie Langton says part of the problem is that Michigan's medical marijuana rules are complicated.

"Caregivers have one set of laws. People who want to set up shops to sell marijuana have another set of laws," said Langton. "And I think what's really going on here is, like any law, it does take a little time for the government to come into sync with the application of this."

Langton says the courts could ultimately decide the medical marijuana policies Michigan cities adopt.

The ACLU of Michigan says at least two Michigan cities have opened themselves to legal challenge by passing ordinances that ban medical marijuana.
