Hutaree Release Delayed Yet Again
The U.S. Sixth Circuit Court of Appeals has issued a stay that temporarily stops the release of nine members Hutaree. Judge Victoria Roberts ruled earlier this week that the government had made the case to keep them in jail pending trial.
But Federal Prosecutors sought a stay to prevent their release. Prosecutors argued that the Hutaree planned to attack a police officer's funeral as part of their plot to spur a larger anti-government uprising. The funeral of a Detroit police officer killed this week is set for Sunday.
Todd Shanker, lawyer for defendant David Stone Jr., called that argument "outrageous." "It was an exploitive argument," Shanker says. "And it's disappointing that that was one of their bases for seeking a stay. I just think it was an improper argument."
Hutaree defense attorneys say they're preparing a response to the stay order. They expect the Appeals Court to make a ruling within the next several days.
