Kilpatrick Restitution Hearing Ends

A judge will decide next month whether former Detroit mayor Kwame Kilpatrick has complied with a court order to pay nearly a million dollars in restitution.

Testimony in Kilpatrick's restitution hearing wrapped up today.

The last day of testimony in Kwame Kilpatrick's restitution hearing saw the former Detroit mayor appear to score several legal victories. In one, Judge David Groner formerly accepted Kilpatrick's explanation as to why he needed be out of town last month on business, forcing a delay in the hearing. The judge had hinted that Kilpatrick faced contempt if he didn't provide proof the delay was due to a business appointment that could not be rescheduled.

Also, the judge berated prosecutors over the purpose of the hearing. Prosecutors insisted the facts showed Kilpatrick had violated the terms of his probation. But Judge Groner said if that was the case prosecutors should have asked for a probation violation hearing, not a hearing to determine if Kilpatrick could pay his restitution.

A decision on Kilpatrick's restitution is expected January 20th. Kwame Kilpatrick was ordered to pay $6 thousand a month restitution as part of his guilty plea to obstruction of justice.
