Man Charged With Killing Abortion Protester Going To Trial

A man charged with killing an abortion protester and a businessman in a small Michigan town will move his case directly to trial in Shiawassee County.

Defense lawyer Robert Ashley said Tuesday there's no reason to hold a probable-cause hearing. He says he'll waive it when Harlan Drake returns to district court on Thursday.

Drake is charged with first-degree murder in the fatal shootings of 63-year-old James Pouillon and 61-year-old Mike Fuoss.

Pouillon was protesting abortion outside Owosso High School, about 70 miles northwest of Detroit, when he was killed in September. Fuoss was shot at his business.

Ashley is considering an insanity defense for the 33-year-old Drake. He's awaiting psychiatric reports.
