Judge Grants New Trial to 2 in Innocence Clinic Case

(Michigan Radio) - A judge in Detroit has granted a new trial for two men who've served eight years in prison for a crime they say they didn't commit.

Marvin and DeShawn Reed were convicted in 2001 in the shooting of a neighbor in Ecorse. But the victim later recanted, and attorney and law professor David Moran says it's clear beyond a reasonable doubt that someone else did the shooting.

"The gun which was used in the shooting was found later in the hands of a person who had been named by an eye-witness and identified by another eye-witness," said Moran. "We had statements from that person to his girlfriend immediately after the shooting in which he admitted that he had done it, and statements to people in the neighborhood that he was either going to do it or had done it."

A spokeswoman for the Wayne County Prosecutor's Office says she'll make a decision about whether to appeal in the next several weeks.

The Innocence Clinic at the University of Michigan represented the Reeds.

Moran says he plans to file a motion soon to get the Reeds released on bond.
