CO Board of Health Updates Medical Marijuana Rules

(KUNC) - During an emergency rulemaking session, the Board repealed language it passed earlier this year defining the relationship between medical marijuana patients and dispensaries.

"The reason the action was necessary was that last week the Colorado Court of Appeals rendered an opinion that a caregiver must do more than just provide marijuana," says Mark Sally, communications director for the Colorado Department of Health and the Environment.

Just exactly how much more is up for debate. Travis Cutbirth is co-owner of Medicial Gardens in Fort Collins, a medical marijuana dispensary. He says he already has personal contact with his patients, and that the change won't impact his day-to-day options, but

"There are bigger question marks than ever," he says. "And the concern is that are they going to try to use these question marks as a wedge to undo the whole thing."

Medical marijuana use became legal in 2000 after voters approved Amendment 20. But Colorado Attorney General John Suthers has said the law is "very vague and contains no regulatory scheme." The Colorado Board of Health will make a more final decision on the rule at its next meeting on Dec 16.
