9R Board Risks Lawsuit, Cancels Election

(ksut) - HOST LEAD: Against the advice of their attorney, members of Durango's 9R school board voted 4-to-2 at a special meeting today to cancel the November 6th school board election.
Ballots were to have been mailed today.
KSUT's Victor Locke reports.

VICTOR: The meeting opened with a moment of silence for school board candidate and State Trooper Mark Dold, who died Sunday, in a motorcycle crash near Ridgway.
Dold was challenging Padraig Lynch in the only contested board race.
Citing a state law the says an election can't be cancelled later than 30-days before, School Attorney Reese Miller recommended the election be held.
Otherwise he says the district could face a lawsuit from someone who might want to run as a last minute write in candidate. concerning
After some discussion, board members voted to cancel the election, saving 10-30 thousand dollars in costs, but risking the lawsuit.
Lynch, and four uncontested candidates were declared winners.
Lynch says he wouldn't be surprised if the board action is challenged.
LYNCH: I HAVE RESERVATIONS ABOUT GETTING ALL EXCITED AND STARTING DOING CARTWHEELS AND STUFF LIKE THAT. THERE IS AN ELEMENT IN THERE THAT DOESN'T WANT TO SEE ME ON THE BOARD.
VICTOR: SO YOU EXPECT THIS TO BE CHALLENGED.
LYNCH: CERTANLY.
The new board members, as of now, are set to be sworn in November 13th.
